Wisconsin has no statewide exemption for small or low decks, so a permit is expected on essentially any new deck. Footings bear on solid ground below the frost line or at least 48 inches below finished grade, whichever is deeper. A deck more than 24 inches above grade needs guards at least 36 inches high with balusters that block a 4 and 3 eighths inch sphere, and stairs with more than three risers need a handrail. The prescriptive rules sit in the Uniform Dwelling Code, SPS 320 to 325, Appendix B.
